The purpose of this privacy policy is to expose you to:

1. ACCEPTANCE OF THESE CONDITIONS
These terms of use ("Terms") govern any use of André Maillé Classic (the "Services"). The Service includes andremailleclassic.ca (the "Site"). By using and accessing the site, you agree to these terms, the privacy policy, other policies and all applicable laws and regulations.
If any of the services on the Site includes additional terms and conditions, privacy statements or other policies ("Additional Terms"), these additional terms will apply in relation to André Maillé Classic. In the event of a conflict between the Additional Terms and these Terms, the Additional Terms will prevail. If you do not want to be bound by these conditions, do not use André Maillé Classic and do not access the site.
2. DEFINITIONS AND WHO IS WHO
Consumers and persons potentially registered for the events organized on the site are both referred to in these conditions collectively as "Users", "Athletes", "you" and "your".
3. WHAT IS MUSCLEWARE AND WHAT IS IT USED FOR
André Maillé Classic provides a standardized way for athletes to register for events and competitions and for the promoter to:
A. organize and promote sporting events;
B. collect and manage information about the participation of athletes in such events; and
C. to manage online registrations for sporting events.
4. THE ROLE OF ANDRÉ MAILLÉ CLASSIC AND WHAT HE DOESN'T DO
André Maillé Classic is not the creator or organizer of the events for which he facilitates registration. André Maillé Classic manages the registration and promotion of events. The Promoter chooses the method of processing payments for its event, but in all cases, the Promoter relies on third parties to process payments or will process payments directly. Athletes must use the payment processing method(s) chosen by the sponsor.
Your payment is not received by André Maillé Classic. Regardless of the processing method chosen by the promoter, André Maillé Classic will not process your payment transaction under any circumstances. André Maillé Classic transmits your payment information to the payment provider designated by the promoter or to the promoter itself. Consequently, André Maillé Classic does not act as an agent of the promoter and assumes no responsibility for your payment to the promoter or his designated third party.
5. YOUR OBLIGATION TO CONFIRM THE ACCURACY OF THE REGISTRATION DATA
When you complete your registration for an event as an athlete, you will receive a confirmation email that will direct you to your athlete page on the site. On this page, you can view the details of your registration, such as your course and other information that you submitted to André Maillé Classic as part of your registration.
It is your duty to verify this information and ensure that it faithfully reflects the information you have submitted to André Maillé Classic. As described in more detail in section 13 of these terms, André Maillé Classic gives no guarantee as to the accuracy of the information on your athlete page and it is your sole obligation to inform André Maillé Classic of such errors or inaccuracies.
6. YOUR USE OF ANDRÉ MAILLÉ CLASSIC
By using the Site or any service provided by André Maillé Classic, you agree not to:
A. violate any law;
B. disseminate false or misleading information;
C. infringe any rights held by third parties (including intellectual property rights);
D. distribute malware, advertising software, viruses or software intended to cause harm or damage to André Maillé Classic or third parties;
F. copy, modify or redistribute any content on the site or the content of any other person; or
F. reverse engineer, decompile or disassemble the André Maillé Classic Site or any part of it, nor attempt to create or derive André Maillé Classic, except in cases authorized by law.
7. REVISION OF CONDITIONS
André Maillé Classic has the exclusive right to revise these Terms at any time and without notice. André Maillé Classic will publish the changes on the site and it is your responsibility to consult these conditions and any changes.
8. Ending
André Maillé Classic has the right, at any time and without notice, to terminate all or part of the services of the Site, any functionality or part thereof, or any product or service offered, and to terminate your right to access or use the Site, its services or any functionality or part thereof.
9. COMPLIANCE WITH THE LAWS
You agree to comply with all applicable laws and regulations regarding your use of the Site.
10. CONTENT AND INTELLECTUAL PROPERTY OF ANDRÉ MAILLÉ CLASSIC
The texts, images, photographs, graphics, videos, logos, illustrations, descriptions, data and other elements of the Site, as well as their selection, assembly and arrangement, are collectively referred to as "History and Gallery".
The content may contain errors, omissions or be obsolete. André Maillé Classic may modify, delete or update the Content at any time. The content is provided for informational purposes only and does not commit André Maillé Classic.
All content, logos, graphics, pages, scripts and service names included or made available through the Site are subject to commercial display, trademarks, trademarks and/or copyright laws and other laws that protect intellectual property in Canada and other countries. The intellectual property of André Maillé Classic may not be used without the written permission of André Maillé Classic. All other trademarks and service marks not belonging to André Maillé Classic that appear on the Site are the property of their respective owners, who may or may not be affiliated, connected or sponsored by André Maillé Classic.
You agree and acknowledge that any unauthorized reproduction, use or disclosure of André Maillé Classic of any part of it is likely to cause irreparable harm to André Maillé Classic, which will therefore be entitled to an injunction to enforce these terms in addition to any other remedy available in law, fairness or otherwise.
You may view and use the Content for your personal information and for the registration of athletes and for no other purpose. André Maillé Classic does not grant you or any other person any right to use, reproduce, copy, modify, transmit, display, publish, sell, license, create derivative works, publicly perform or distribute by any means, method or process whatsoever, currently known or further developed, all or part of the Content on or transmitted via the Site. If André Maillé Classic did not grant it to you.
By using the site and providing information and content to André Maillé Classic, you hereby grant André Maillé Classic an irrevocable and unlimited license to use any material protected by copyright, trademark or other form of intellectual property that belongs to you or that is transferred to you. By agreeing to these terms, you warrant that you have obtained the necessary consent and permission from any other interested party regarding the photographs or information you provide to Muscleware for publication on the site or otherwise.
11. ATHLETE REGISTRATION
The site may allow you or ask you to enter information for additional benefits, including registration as an athlete in a sports competition. You agree to provide, maintain and update true, accurate, current and complete information about you, as requested by our registration processes. You must not impersonate a person or entity, or distort your identity or affiliation with a person or entity, including using the name, likeness, image or photograph of another person. You also agree to promptly notify André Maillé Classic at andremailleclassic@gmail.com of any unauthorized use of personal or account information or any security breach involving or linked to the Site.
12. YOUR CONTENT
André Maillé Classic allows you to submit content, including (but not limited to) your name, phone number, photograph, contact information and other information, data and works. Any material (including the previous categories) that you provide to contribute, provide, publish or make available from André Maillé Classic is "Your Content".
André Maillé Classic does not make any claims about your content. However, you are solely responsible for your content. You hereby grant André Maillé Classic a non-exclusive, global, perpetual, irrevocable, royalty-free, transferable and sub-licensable right and license to access, use, reproduce, transmit, adapt, modify, perform, display, distribute, translate, publish and create derivative works based on your content, in whole or in part, in any media, for the purpose of exploiting the services (including the promotional services and marketing services of André Maillé Classic, which may include, without limitation, the promotion of a sporting event on a third party website), and you hereby waive any moral right to use the name you Submit with your content.
You represent and warrant that you have all the rights, powers and authority necessary to grant the aforementioned license, and that all your content:
A. does not infringe, violate, divert or conflict with the rights of a third party;
B. complies with all applicable local, provincial, provincial, national and other laws, rules and regulations; and
C. does not contravene these conditions.
13. NOTICE OF LIABILITY AND LIMITATION OF LIABILITY
Except as prohibited by applicable law, André Maillé Classic makes no warranty or representations regarding the Site, any linked site or its content, including the availability of any site or content, information and documents it contains or the accuracy, completeness or timeliness of such content, information and documents. André Maillé Classic also does not guarantee or represent that your access to or use of the Site or any linked site will be uninterrupted or free of errors or omissions, that defects will be corrected or that the Site or any linked site is free of computer viruses or other harmful components. Without limiting the foregoing, all content provided on or through the Site is provided to users "as is", without any warranty of any kind, express or implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy. The "as is" condition of the content is expressly considered a condition of any transaction arising from or resulting from Muscleware's services.
Unless the applicable law prohibits it, André Maillé Classic will in no event be liable to you for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with the use of the Site, whether based on a breach of contract, a breach of warranty, tort (including negligence, product liability or otherwise), or any other pecuniary loss, whether or not André Maillé Classic has been informed of the possibility of such damages. André Maillé Classic will in no way be responsible to you for any amount.
14. ELECTRONIC COMMUNICATION
By using the site, you agree to receive communications from André Maillé Classic electronically. André Maillé Classic will contact you by email or by posting reviews on the site. You agree that all notices, disclosures, agreements and other communications that André Maillé Classic may provide electronically satisfy any legal requirement that such communications must be written.

Links to other websites operated by third parties, including André Maillé Classic's providers (if any), do not constitute endorsement, or endorsement by André Maillé Classic of the content, policies or practices of such linked sites. 16. REGISTRATION AND PAYMENT
André Maillé Classic reserves the right, at any time after receipt of your registration, to accept or refuse your registration, or any part of it, even after receipt of your registration from André Maillé Classic, for any reason whatsoever. André Maillé Classic reserves the right to modify your registration and refuse any service to any athlete without notice.
As soon as André Maillé Classic transmits the information relating to the registrant to the promoter of the sports competition or the specific show for which you have registered, the risk of loss and the title deed for the maintenance of your registration are transferred to you.
17. DISPUTES
Any dispute concerning the payment of your registration will be addressed to the Promoter. You agree that under no circumstances will André Maillé Classic be responsible for the losses you suffer as a result of the recovery of your payment by the promoter or his designated third party.
18. RELEASE AND COMPENSATION
To the maximum extent permitted by applicable law, you agree to hold André Maillé Classic and their subsidiaries, affiliates, officers, officers, agents, licensees or other respective partners and employees, harmless from and against any third party claim arising out of or related in any way to your use of the site, including any liability or expense arising out of all claims, losses, damages (real and/or consequential), prosecutions, judgments, litigation fees and attorneys' fees, or of any kind and nature.
19. CHOICE OF APPLICABLE LAW
These conditions are governed by the laws of the province of Quebec, Canada. You accept the jurisdiction of Quebec and you will bring any claim relating to the use of the Site or these Terms in Quebec, Canada.
Nothing in this section prevents André Maillé Classic from requesting an injunction or other fair measure from the courts for issues related to data security, intellectual property or unauthorized access to the site.
20. NO WAIVER
No waiver of any of the terms of these Terms shall be deemed an additional or continuing waiver of that term or any other condition, and the fact that André Maillé Classic does not assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
21. ENTIRETY OF THE AGREEMENT AND DIVISIBILITY
These conditions, as well as the privacy policy, all additional conditions and any additional agreements that you may conclude with André Maillé Classic, will constitute the entire agreement between you and André Maillé Classic. If any provision of these Terms is found to be invalid, that provision will be limited or limited to the minimum extent necessary, and the other provisions of these Terms will remain in force and effect.
